Terms and conditions

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“customer,” “you”) and MD Clean, LLC (“MD Clean,” “company,” “we,” “us,” or “our”) as an authorized user of such services provided by the company and any of its subsidiaries.

 

These Terms and Conditions and any other operating rules, policies, price schedules, or other supplemental documents published by MD Clean will collectively constitute the “Agreement” between MD Clean, LLC, and you regarding the bin cleaning service. By using the service, you confirm your acceptance and Agreement bound by this Agreement.

 

These Terms and Conditions constitute a legally binding agreement concerning your access to and use of our website, www.mdclean.us,  and any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected to that (collectively, the “Site”). You agree that by accessing the Site, you have read, understood, and agreed to be bound by these Terms and Conditions.

 

  1. Service

MD Clean, LLC provides a mobile Bin cleaning service for residential. Residential service will be performed and billed on a subscription basis. MD Clean will make every effort to clean your bin to the best of our ability, but we reserve the right not to clean a bin for any reason deemed hazardous or a liability to our safety. We will always do our best, but we cannot guarantee that all stains will be removed due to the stain’s age, type, color, or the bin’s age, type, color, or material.

 

  1. Customer Responsibilities for Residential Bin Cleaning Services

For MD Clean, LLC to provide its services, the customer must abide by the following conditions or the service could be interrupted or postponed. Bin(s) MUST be:

  • Free of un-bagged trash and animal waste. Bins containing unbagged feces will not be cleaned.
  • Empty and available by the curb or alley.
  • Free of chemicals, oils, petroleum-based products, oil-based paint, glue or other adhesive, or hazardous waste of any kind.
  • Free of building materials, e.g., plaster, stucco, or concrete.
  • A vacation hold may be placed on service. The customer must notify MD Clean, LLC by phone or email 48 hours before the scheduled service. The service will be temporarily suspended, and the customer will not be charged until the service resumes.

 

If any of the above conditions are not met, MD Clean, LLC reserves the right not to perform the service(s), and the customer is still responsible for a total payment. If MD Clean, LLC cannot perform the service, a picture may be sent to the customer via email and/or text with an explanation.

 

MD Clean, LLC reserves the right not to clean damaged bins. We will message you and provide a picture of the damaged bin(s) with a replacement recommendation.

 

  1. MD Clean, LLC Responsibilities

MD Clean, LLC will schedule the customer’s service on a pre-planned route and notify the customer leading up to the day of service via email and/or text message. MD Clean, LLC will attempt to service all bins on its pre-planned route. Once the customer’s bins have been serviced, the customer will be invoiced, and their stored credit card will be automatically charged for the service. Our technician will take before and after photos.

 

If MD Clean, LLC cannot provide its service(s) on the scheduled day due to inclement weather, vehicle maintenance, unforeseen events, or otherwise, it will try to notify the customer in advance and reschedule the customer to the next available opportunity. Due to route scheduling conflicts and/or extended inclement weather, the service visit may be canceled until the following scheduled service date. The customer will not be charged if service cannot be performed due to these reasons.

 

All trash bins designated for cleaning by the customer will be tagged (sticker placed on the bin) at the first servicing appointment. These tags must always stay on the designated trash bins and not be tampered with. MD Clean will only service trash bins that have been tagged. Any other trash bins will only be serviced upon request by the customer and will be billed for the additional trash bins serviced at the current rate found on www.MDCLEAN.us

 

  1. Charges

The customer agrees to pay all service charges for the service(s) and applicable taxes. MD Clean, LLC reserves the right to adjust pricing at any time. Changes in pricing may be communicated to the customer via updates to the website and/or email. The customer’s right is to continue or discontinue the service at any time. The service will continue until canceled by the customer. Customers may request a change to the selected service plan seven days before the next service. 

 

Monthly and Quarterly Recurring Payment Plans:

  • Plans are recurring in nature and will auto-renew. The customer is charged at the time of sign-up in advance of their first service. 
  • Customers must have an active Debit Card or Credit Card stored on file and have accepted automatic future charges.
  • Customers will be billed based on a recurring payment plan after service is completed, either monthly or quarterly. i.e., Monthly plans will be charged in one-month increments (12), and Quarterly plans will be charged in Quarterly increments (4) based on a full year of service. 
  • The customer is responsible for paying for the service requested regardless of the number of bins present and available for cleaning.
  • An invoice is created after each payment
  • Service is ongoing until the customer cancels service.
  • No refunds will be issued after our service has been completed. If, for any reason, you are not happy with our service, please notify us via email. All complaints are taken seriously. If you are not 100% happy with any aspect of our service, please email, text, or call us as soon as possible and give us a chance to rectify it. We strive for 100% customer satisfaction. 

 

MD Clean, LLC will use industry leaders in payment processing to safely and securely store customers’ credit card information safely and securely. The customer’s card will be run automatically after service, and an invoice will be generated. 

 

  1. Referral Program

Existing subscription customers in good standing may be eligible to receive a $5 credit per referral of a new first-time paying subscription customer. Referrals of One-Time Services are not eligible for a $5 credit. There is no limit to the Referral Program.

 

  1. Modifications to Terms and Conditions and/or Customer Agreement

MD Clean, LLC reserves the right to modify and/or amend the Terms and Conditions and/or the Customer Agreement at any time by posting a revised Terms and Conditions and/or the Customer Agreement at www.MDCLEAN.us and/or sending information regarding the amendment to the email address you provided to MD Clean, LLC.

 

  1. Modifications to Service

MD Clean, LLC reserves the right to modify the service anytime for our customers’ betterment and the service program’s overall success.

 

  1. Default Payments

MD Clean, LLC reserves the right to suspend or terminate your service without notice upon rejection of any credit or debit card charges or if the customer’s card issuer (or its agent or affiliate) seeks the return of payments previously made to MD Clean, LLC. Such rights are in addition to and not in place of any other legal rights or remedies available to MD Clean, LLC.

 

  1. Cancellation of Subscription Service

The customer may cancel a subscription service at any time. However, if you cancel your package (monthly or quarterly) after the first service visit, you will be subject to a one-time service fee of $50. Cancellation must occur 14 days in advance of the next scheduled service date. A cancellation notice is required via email; please send it to jlevy@mdclean.us with “cancelation” in the subject line.

 

  1. Customer Information

We do not sell, trade, or rent customers’ personal identification information to others. MD Clean, LLC utilizes industry-leading PCI-compliant credit card information storage through their payment processor. By signing up for our service, emailing us, calling or texting this number 866-378-9246, Customers agree to receive text and email messages from MD Clean. If you no longer wish to receive messages at any time, you may opt-out by replying “STOP” to the text or email.

 

  1. Sanitization and Disinfection

The customer understands that MD Clean, LLC’s high-pressure hot water is an excellent defense against germs and the environments in which they thrive. However, MD Clean, LLC cannot guarantee the complete elimination of all contagions within, around, and on garbage bins. MD Clean, LLC will make all reasonable efforts to sanitize and disinfect to the best of its ability but will make no claims to prevent disease and/or the spread of contagions.
